Do I have the same rights against all banks?

You have a contract with the bank and they also owe you a duty of care where they provide advice. Their responsibilities go well beyond the mis-selling of PPI and extend to pensions, investments and the nature of loans and personal guarantees. They have got away with murder but no longer. We are on their trail. Their advice often goes beyond their actual level of expertise and their level of honesty is sadly lacking. They can be beaten either for breach of contract and/or for breach of their duty of care.

What can I claim for?

Each case depends upon its own facts. The basis measure of damages is that in a claim based on contract, you should be put in the same position as if the breach had never occurred. In negligence, the damages are not so limited and can extend to all foreseeable losses.

How can I fund such a claim?

In certain cases, we will act on a no win no fee basis. In other instances, we will work on a fixed fee basis. In any event, to discuss any potential claim, we will never charge you for a free initial assessment. You have nothing to lose by talking to us. And you have much to gain.

Is there any limit upon what I can claim for or who I can claim against?

In essence no, as any bank operating in England and Wales is subject to the similar obligations. You can refer any matter to the Banking Ombudsman and if not happy, then seek a judicial review in the High Court. The other route is to seek compensation by threatening and then bringing proceedings against the offending bank in the County or high Court.
